1. General Use

• By accessing and using our website, you confirm that you are legally capable of entering into contracts.
• We reserve the right to update these Terms of Use from time to time. Your use and continued use of our site means you accept any changes.
• We exercise due care in putting information on our website.  Should the information be incomplete or not updated, we reserve the right to change, correct or update the information without prior notice.

2. Products & Descriptions

• We take great care in showcasing our furniture and home products through accurate descriptions and photos.
• As most of our products are made from natural solid wood and heritage materials, slight variations in color, grain, or finish are normal and part of their uniqueness.
• Product specifications and features described in our website are subject to change without prior notice. Due to lighting and variations in appearance of items in different computer or device screens, the actual color and finishing appearance of our products may slightly differ from those seen on screen.  
• As both machines and hand-guided tools and equipment are used in the manufacture of our furniture pieces, there may at times be a slight difference in dimensions. 

3. Pricing, Orders, & Payments

• Orders are confirmed once payment is successfully processed through our secure payment channels (credit card, debit card, e-wallet, or other available options).
• Prices are shown in Philippine Peso (PHP) and are inclusive of applicable taxes, unless stated otherwise.
• We reserve the right to cancel orders in cases of payment issues or product unavailability. Customers will be notified promptly in such cases.

4. Shipping & Delivery

• We partner with trusted courier and logistics providers to deliver your orders.
• Shipping fees, timelines, and coverage areas will be disclosed upon checkout or confirmation of customized orders.
• Once the order is shipped, tracking details will be provided. Delivery timelines may vary depending on location, courier policies, and unforeseen events (e.g., natural disasters, transport disruptions).

5. Returns & Refunds

• Returns and refunds are governed by our Return & Refund Policy, in compliance with law.

6. Retention of Ownership

• Despite delivery and acceptance of products by the customer, their ownership remains with Timbertale Designs until full payment of the purchase price.  However, the risk of loss shall pass to the customer upon receipt of the products or pick up of the products by the logistics provider directly hired by the customer.

7. Intellectual Property

• All content on our website, including photos, text, graphics, designs, as well as design drawings and product designs are owned by Timbertale Designs and protected under intellectual property laws.
• Any and all intellectual property rights on or in relation to the products purchased or delivered remain with Timbertale Designs.
• You may not reproduce, distribute, or use any content, design drawings, and product designs without our written permission.

8. Privacy & Data Protection

• Your personal information is collected and processed in accordance with our Privacy Policy, compliant with applicable laws. 

9. Waiver

• Any waiver by Timbertale Designs of any breach of these Terms of Use by the customer shall not be held or construed to be a waiver of any other breach thereof. Failure of Timbertale Designs to avail of a remedy or to demand the performance of any of the terms of a sale shall not be understood as abandonment, cancellation or waiver of such remedy or demand. Any waiver by Timbertale Designs shall be expressed in writing and signed by its authorized representative.

10. Governing Law & Dispute Resolution

• • These Terms of Use are governed by the laws of the Republic of the Philippines.
  • In case of disputes, both parties agree to first seek amicable settlement. If unresolved, disputes shall be settled before the proper courts of Marikina City, Metro Manila (or our chosen jurisdiction).
